Two common scenarios
Employees can experience any number of problems related to regular and overtime pay. The following examples, however, are common wage claims disputes:
- Overtime pay disputes - Overtime pay disputes can occur when an hourly employee is misclassified as a salaried employee. Generally, hourly employees are entitled to overtime pay; salaried employees are not. Immigrant workers are especially vulnerable to nonpayment of overtime. Our firm has extensive experience identifying an employee's actual status and ensuring employees receive appropriate compensation.
- Nonpayment of final paycheck - In another scenario, an individual is fired and does not receive his or her final paycheck. Generally, employers can withhold payment of a final check only in situations when they claim the employee has stolen from the employer.
Class actions
Our firm represents groups of employees who have been similarly affected by nonpayment of wages. These are handled as class actions.
